TMC offers various subscription plans with different features and limitations. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. All fees are exclusive of taxes, which you are responsible for paying.

Subscription fees are billed in advance on a recurring basis, depending on the billing cycle you select. You authorize us to charge your payment method for all fees incurred in connection with your account.

You may cancel your subscription at any time, but no refunds will be provided for any unused portion of your subscription period.

4. User Content

The Services allow you to create, upload, store, and share content, including text, images, and other materials ("User Content"). You retain all rights in your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with providing and improving the Services.

You are solely responsible for your User Content and the consequences of posting or publishing it. By posting User Content, you represent and warrant that you have all necessary rights to do so and that your User Content does not violate these Terms or any applicable laws.

5. Prohibited Conduct

You agree not to:

• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

IN NO EVENT WILL TMC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
